The Law Office of Mary Beth Caudill

Dayton, Ohio DUI Defense Lawyer

The penalties for drunk driving are serious, even for first time offenders. While all DUI convictions carry fines, license suspension, and jail time, working with prosecutors in exploring sentencing alternatives can result in the reduction of charges against you. At the law office of Mary Beth Caudill, I evaluate your driving record and the circumstances surrounding your DUI arrest. I determine whether or not the officer had reasonable suspicion to pull you over and whether your field sobriety test was conducted according to proper procedure. Where the evidence and charges against you are not in question, I ask the court to consider counseling programs, community service, or educational work in exchange for a reduction in jail time.

I am an experienced traffic attorney with over 25 years of experience.  I am a former Vandalia Municipal Court Prosecutor.

Don't lose your license or freedom because you failed to talk to an attorney—contact the law office of Mary Beth Caudill today. Located in Dayton, Ohio, my office represents clients throughout Beavercreek, Xenia, Kettering, Miamisburg, Bellbrook, and Trotwood.

When Serious Questions Arise Regarding the Evidence Against You

While the vast majority of DUI cases seem simple and straightforward, improperly administered field sobriety tests or malfunctioning breathalyzers can result in the charges against you being dismissed. As your defense attorney, I carefully review the police report, any available dashboard video of your arrest, and work closely with you to learn whether or not the arresting officer followed proper procedure.

My office also requests maintenance records and information regarding the breathalyzer used for your blood alcohol test. If calibrated improperly or in poor working condition, the results of a breathalyzer may be inaccurate. Additionally, results can vary depending on how hard or long you blow into the device, leading to artificially high readings in some instances.

Repeat DUI Offenders

The penalties for drunk driving and driving under the influence increase with multiple convictions. Most repeat offenders face jail time, loss or suspension of their license, increased fines, even the installation of an interlock ignition device on their car. Additionally, those convicted for felony DUI may be subject to electronically monitored home arrest.

While it is unlikely that repeat offenders will avoid jail or the suspension of their license, my office can work to reduce the amount of time involved. Depending on your driving record and the circumstances surrounding your arrest, the court can be persuaded to lessen jail time and the duration of the suspension or revocation of your license.
